Sign up for\u00a0<a href=\"https:\/\/votebe.at\/texasnewsletter\">Votebeat Texas\u2019 free newsletters here<\/a>.<\/em><\/em><\/p>\n\n\n\n<p>President Donald Trump on Tuesday <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/03\/ensuring-citizenship-verification-and-integrity-in-federal-elections\/\">issued a second executive order on elections<\/a>, this one giving the U.S. Postal Service unprecedented oversight over who is voting by mail, a move certain to draw legal challenges.<\/p>\n\n\n\n<p>The order, titled \u201cEnsuring Citizenship Verification and Integrity in Federal Elections,\u201d says that states must send the U.S. Postal Service a list of voters \u201cto whom the State intends to provide a mail-in or absentee ballot\u201d 60 days before any federal election, and directs the Postal Service to create \u201cunique ballot envelope identifiers, such as bar codes\u201d for those voters.<\/p>\n\n\n\n<p>The Postal Service would only be authorized to deliver ballots from people on the list.<\/p>\n\n\n\n<p>States would be allowed \u201cto routinely supplement and provide suggested modifications or amendments\u201d to its list of mail voters.<\/p>\n\n\n\n<p>Separately, the executive order also directs the U.S. Department of Homeland Security to work with the Social Security Administration and use other federal databases to create a list of all adult citizens residing in each state and send it to the state\u2019s chief election official, though it noted that voters would still be required to register to vote in accordance with state law.<\/p>\n\n\n\n<p>While signing the executive order Tuesday evening, Trump told reporters at the White House that the order was about ensuring voter integrity. \u201cWe want to have honest voting in our country, because if you don\u2019t have honest voting, you can\u2019t have, really, a nation.\u201d<\/p>\n\n\n\n<p><a href=\"https:\/\/electionlawblog.org\/?p=155187\">Experts said<\/a> the order will be immediately challenged and that, practically speaking, even if it weren\u2019t, it would be difficult to implement before the November election.<\/p>\n\n\n\n<p>\u201cThe president has no power to direct the creation of any of these lists or to restrict the delivery of mail ballots to any given list,\u201d said Danielle Lang, vice president for voting rights at the nonprofit Campaign Legal Center, which represented plaintiffs suing over Trump\u2019s first executive order on elections.<\/p>\n\n\n\n<p>Trump issued his first executive order on elections <a href=\"https:\/\/www.votebeat.org\/2025\/03\/26\/trump-executive-order-elections-mail-ballots-proof-of-citizenship\/\">just over a year ago<\/a>. Among other things, it attempted to require registering voters to provide documented proof of citizenship and prohibit the counting of mail ballots that are postmarked by Election Day but arrive afterward. However, <a href=\"https:\/\/www.votebeat.org\/2025\/04\/24\/trump-executive-order-elections-preliminary-injunction\/\">federal courts<\/a> have repeatedly ruled the president <a href=\"https:\/\/www.votebeat.org\/2025\/06\/13\/trump-executive-order-on-elections-proof-of-citizenship-injunction\/\">lacks the authority<\/a> to rewrite election law and <a href=\"https:\/\/www.votebeat.org\/2026\/01\/13\/trump-ruling-latest-defeat-election-executive-order\/\">have so far blocked<\/a> the order\u2019s major provisions.<\/p>\n\n\n\n<p>Lang said those court rulings \u201cprovide a clear roadmap\u201d for challenges to this one.<\/p>\n\n\n\n<p><a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artI-S4-C1-2\/ALDE_00013577\/\">Article I, Section 4 of the Constitution<\/a> gives states and Congress the power to make laws governing elections, not the president. Despite that, the White House has <a href=\"https:\/\/x.com\/NewsHour\/status\/1985810932807721144?s=20\">promised for months<\/a> that a second executive order on elections was forthcoming, sparking widespread speculation about what it would include. The order Trump issued Tuesday was less sweeping than some had expected.<\/p>\n\n\n\n<p>Rick Hasen \u2014 a professor of election law at the University of California Los Angeles \u2014 said the executive order is \u201cpretty mild, given what could have been, but it\u2019s still unconstitutional and not something that could really be implemented in time.\u201d<\/p>\n\n\n\n<p>Asked whether the U.S. Postal Service and Department of Homeland Security could realistically implement the changes in time for the November election, Hasen was blunt: \u201cNo way.\u201d He added that if the administration attempted to move forward anyway, \u201cIf they try and do it, courts would stop it.\u201d<\/p>\n\n\n\n<p>Even in the absence of immediate court intervention, he warned the effort \u201cis going to conflict with all kinds of state laws that provide for a late sending of mail-in ballots to newly eligible voters and to voters who simply put in a late request.\u201d<\/p>\n\n\n\n<p>More fundamentally, Hasen emphasized that the proposal misunderstands the constitutional structure of election administration. \u201cThe fundamental point is that the constitution doesn\u2019t give DHS any power over elections,\u201d he said. \u201cThe power to run state elections rests with the states. The power to run federal elections rests with the states,\u201d except where Congress chooses to act \u2014 and, he noted, \u201cthe president is not Congress.\u201d<\/p>\n\n\n\n<p>Trump has tried passing his election agenda through legislative means, but so far he <a href=\"https:\/\/www.votebeat.org\/national\/2026\/03\/16\/donald-trump-john-thune-save-america-act-senate-filibuster-voting-elections\/\">hasn\u2019t had much success<\/a>. Two bills that would require documented proof of citizenship to register to vote, the SAVE Act and the <a href=\"https:\/\/www.votebeat.org\/2026\/02\/06\/republicans-congress-election-integrity-bills-trump-proof-of-citizenship-photo-voter-id\/\">SAVE America Act<\/a>, have passed the House but stalled in the Senate, where the filibuster rule effectively means legislation needs 60 votes to pass. The president has repeatedly called on Republican senators to eliminate the filibuster and pass the legislation, which he has said is his top priority, but they\u2019ve so far been reluctant to do so.<\/p>\n\n\n\n<p>Republicans have had a bit more luck <a href=\"https:\/\/www.votebeat.org\/national\/2026\/03\/30\/trump-influence-state-election-laws-2026-midterms\/\">changing election law in GOP-led states<\/a>, multiple of which have passed proof-of-citizenship requirements and moved mail-ballot receipt deadlines up to Election Day.<\/p>\n\n\n\n<p>But Trump, who has long railed against mail voting, has repeatedly signaled that piecemeal action would not be enough.
